Terms and Conditions

The ground rules for using this website and BenchBoss.

These terms apply to this website and the BenchBoss league and team management service (together, "BenchBoss"). By using BenchBoss, you agree to them. If you use BenchBoss on behalf of a league, team or organization, you agree on its behalf and confirm you have the authority to do so. Our Privacy Policy explains how we handle information.

Eligibility

You must be at least 13 years old to create a BenchBoss account. If you're under the age of majority where you live, a parent or guardian must agree to these terms for you. To agree on behalf of an organization or to make payments, you must be an adult.

Accounts

Keep your sign-in details secure and your account information accurate. You're responsible for activity under your account. Tell us promptly if you think someone else has accessed it.

Organizers and your content

Leagues, teams and organizations own the information they and their members add, such as rosters, schedules, scores and messages. You give us permission to host, process and display that content only as needed to provide BenchBoss.

Organizers are responsible for:

  • Having the right to add the people and information they manage, including permission from a parent or guardian for minors.
  • Setting visibility so information is shared only with the people who should see it.
  • Their own registration policies, fees, refunds and communications with members.

Acceptable use

When using BenchBoss, don't:

  • Break the law, or violate anyone's privacy or intellectual property rights.
  • Post content that harasses, threatens or exploits others, especially minors.
  • Send spam or messages people haven't agreed to receive.
  • Try to access accounts or data you aren't authorized to, or interfere with the service's security or operation.
  • Copy, resell or reverse engineer the service, except where the law allows it.

Text messages

If you provide a mobile number and turn on text notifications, you agree to receive messages about the leagues and teams you belong to, such as schedule changes and reminders. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers aren't liable for delayed or undelivered messages.

Fees and payments

Some BenchBoss plans and features are paid. Fees, billing periods and included features are shown before you subscribe. Payments are processed by our payment provider and are subject to its terms. Registration fees that a league charges its members are set by that league, which is responsible for its refund policy.

Beta

During the beta, features may change, be limited or be removed, and the service may be unavailable at times. We appreciate feedback and may use it to improve BenchBoss without obligation to you.

Third-party services

BenchBoss relies on third-party services, such as payment processing, and may link to other websites. Your use of those services is subject to their own terms, and we aren't responsible for them.

Our property

BenchBoss, including its software, design and brand, belongs to us and our licensors. These terms don't give you any right to use our name or logos without permission.

Suspension and termination

You can stop using BenchBoss at any time. We may suspend or end access if you break these terms or create risk for other users or BenchBoss. Where reasonable, we'll give notice and a chance to export your organization's content.

Disclaimers

BenchBoss is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee the service will be uninterrupted or error free.

Limitation of liability

To the extent the law allows, BenchBoss won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim related to BenchBoss is limited to the amount you paid us in the 12 months before the claim, or US$100 if you haven't paid us.

Indemnification

To the extent the law allows, you agree to defend and hold BenchBoss harmless from claims, losses and expenses, including reasonable legal fees, that arise from your content, your organization's activities or your breach of these terms.

Changes to these terms

We may update these terms as BenchBoss grows. When we do, we'll change the date above. If you have an account, we'll let you know of material changes before they take effect. Continuing to use BenchBoss after changes take effect means you accept them.

General

These terms and the policies they reference are the entire agreement between you and BenchBoss about the service. If any part is found unenforceable, the rest stays in effect. Not enforcing a term isn't a waiver of it. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
